SPECTRUM VANDALISM REWARD PROGRAM TERMS AND CONDITIONS

The Spectrum Vandalism Reward Program (the “Program”) is available only to legal U.S. residents who are eighteen (18) years of age and have reached the age of majority in their state of residence who reside in the following AL, CA, KY, NC, SC, TX, KS, MO, and IL. By participating in the Program, each participant unconditionally accepts and agrees to comply with and abide by these Terms and Conditions and the decisions of Charter Communications Operating, LLC (“Spectrum”), which shall be final and binding in all respects. This Program is void where prohibited by law.

The Program is intended to help Spectrum stop criminal acts of vandalism and theft that are impacting its services. The Program encourages you to provide credible tips to Spectrum and law enforcement and may lead to a potential cash reward from Spectrum if your tip leads to a criminal arrest. Spectrum takes the reliability of its services very seriously and has committed significant resources to stopping acts of theft and criminal vandalism to its communications network. Spectrum’s cables/lines do not contain copper or other precious metals that thieves often seek. Spectrum monitors its network closely, with 24-hour network surveillance 365 days per year and will prosecute those who intentionally damage its network.

In connection with the Program, Spectrum is offering a reward in an amount up to $5,000 to any person who provides credible information leading directly to the arrest and conviction of any individual(s) involved in theft or vandalism of the Spectrum network. Reward amounts may vary by market and based on information provided, as determined by Spectrum in its sole discretion. ALL REPORTS MUST BE CREDIBLE. SPECTRUM WILL PURSUE ANYONE ABUSING THE PROGRAM. To be eligible for any reward, the information must be provided to Spectrum at 833-404-TIPS (8477) and to the law enforcement agency with jurisdiction over the theft or vandalism. If more than one individual provides information leading directly to an arrest for the same crime, any reward deemed appropriate by Spectrum may be shared among the reporting individuals as determined by Spectrum in its sole discretion. SPECTRUM MAY DISCONTINUE THIS PROGRAM AT ANY TIME. SPECTRUM MAY ELECT TO ISSUE REWARDS OR NOT IN ITS SOLE DISCRETION.

Reward recipients shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with a reward. Reward recipient agrees to complete any forms necessary for Spectrum to fulfill its reporting requirements in connection with a reward.

Program participants agree that the Spectrum (A) shall not be responsible or liable for, and is hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Program or any Program-related activity, and (B) has not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any reward which may be paid in connection with the Program. Spectrum reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the operation of the Program or acting in violation of these Terms and Conditions or to be acting in an abusive or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Program, or to annoy, abuse, threaten or harass any other person, and Spectrum reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event any provision of these Terms and Conditions is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

ALL ISSUES AND QUESTIONS CONCERNING THE PROGRAM AND CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE TERMS AND CONDITIONS OR THE RIGHTS AND OBLIGATIONS OF PARTICIPANTS OR SPECTRUM IN CONNECTION WITH THE PROGRAM SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL

LAWS OF THE STATE OF MISSOURI WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

Participant agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Program, or any rewards shall be resolved individually, without resort to any form of class action; participant submits to sole and exclusive personal jurisdiction to said courts in the State of Missouri for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with notifying Spectrum under this Program but in no event attorneys’ fees; and (c) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

Participants may provide personal information to Spectrum. Spectrum collects this information and uses it to administer this Program. Spectrum may share this information with third parties who need access to this information to investigate or perform services related to the Program on Spectrum’s behalf.
